Gov. Bill Lee needs a
wake-up call to get out of the Grasps of the power hungry
Bureaucrats and recognize
He has been deceived the TN constitution does not even contain the
word “EMERGENCY” and the TCA 58-2-102 is clearly unstitutional
when it says “ the governor may issue executive orders,
proclamations, and rules and may amend or rescind them. Such
executive orders, proclamations, and rules have the force and effect
of law.”
The Legislative branch
does not have the power to give it's law making powers to the
Executive without amending the State's Constitution. I am not
practing law but simply of the opinion that by filing a Declaratory
Judgement Action the Judiciary could void these Executive Orders,
Wherefore Executive
Orders have eliminated business activity personal liberties and God
given rights that perform “close-contact personal services” and
public gatherings for “ Entertainment and recreation … venues”
.
By taking action a
Declaratory Action participants recognize there is no financial claim
being sought only
Constitutional relief, only the hope that the Constitution be
restored.

“58-2-107. Emergency
management powers of the governor.
(a)
(1) The
governor is responsible for addressing the dangers presented to this
state and its people by emergencies. In the event of an emergency
beyond local control, the governor, or, in the governor's absence,
the governor's successor as provided by law, may assume direct
operational control over all or any part of the emergency management
functions within this state, and such person has the power through
proper process of law to carry out this chapter. The governor is
authorized to delegate such powers as the governor may deem prudent.
(2) Pursuant
to the authority vested in the governor under subdivision (a)
(1), the governor may issue executive orders, proclamations, and
rules and may amend or rescind them. Such executive orders,
proclamations, and rules have the force and effect of law.
